The British Technology Group Act 1991 (Modification and Saving) Order 1992

The Secretary of State, in exercise of the powers conferred on him by section 17(1) of the British Technology Group Act 1991(1) (“the Act of 1991”) hereby makes the following Order:—

1.  This Order may be cited as the British Technology Group Act 1991 (Modification and Saving) Order 1992 and shall come into force on 31st January 1992.

2.  In the Enterprise and New Towns (Scotland) Act 1990(2) (“the Act of 1990”) in section 31(1) (which applies section 9 of the Industry Act 1975(3) in relation to Scottish Enterprise as it applies in relation to the National Enterprise Board) for the words “it applies in relation to that Board” there shall be substituted “if any reference in that section to the Board were a reference to Scottish Enterprise”.

3.  The repeal of section 9 of the Industry Act 1975 by section 17(2) of and Schedule 2 to the Act of 1991 shall not affect the continuing operation of section 9 for the purposes of section 31(1) of the Act of 1990 (as modified by article 2 above).

4.  Articles 2 and 3 of this Order shall be deemed to have effect as from the appointed day(4), within the meaning of the Act of 1991 (6th January 1992).

Explanatory Note

(This note is not part of the Order)

Section 31(1) of the Enterprise and New Towns (Scotland) Act 1990 provides that section 9 of the Industry Act 1975 (the National Enterprise Board and the media)shall apply in relation to Scottish Enterprise as it applies inrelation to that Board. Section 9 was repealed by the British Technology Group Act 1991 on the appointed day under that Act (6th January 1992). The purpose of this Order is to save the application of section 9 in relation to Scottish Enterprise. This is effected by modifying section 31(1) of the Enterprise and New Towns (Scotland) Act 1990 so that any reference in section 9 of the Industry Act 1975 to the National Enterprise Board is to be treated as a reference to Scottish Enterprise (Article 2)and by providing that for the purposes of the said section 31(1), as modified, the repeal of section 9 of the Industry Act 1975 shall not affect the continuing operation of that section, in relation to Scottish Enterprise (Article 3).

This Order is made under section 17(1) of the British Technology Group Act 1991 and in accordance with that subsection it is made so as to have effect from the appointed day under that Act.
