The Secretary of State for Education, as respects England, the Secretary of State for Wales, as respects Wales, and the Secretary of State for Scotland, as respects Scotland, in exercise of the power conferred by section 21(3) of the Education (Schools) Act 1992(1), hereby make the following Order—
1.—(1) This Order may be cited as the Education (Schools) Act 1992 (Commencement No. 2 and Transitional Provision) Order 1993.
2. In this Order “the 1980 Act” means the Education Act 1980(2) and “the 1992 Act” means the Education (Schools) Act 1992.
3. Subject to article 4 of this Order, sections 14 and 17 of, paragraphs 7 to 9 (so far as they are not already in force) of Schedule 1 to, paragraphs 1 to 3 of Schedule 2 to and (so far as it relates to those provisions) section 9(7) of, paragraphs 2 and 3 (so far as they are not already in force) and 4 of Schedule 4 to and (so far as it relates to those provisions and is not already in force) section 21(7) of the 1992 Act shall come into force on 1st May 1993.
4. Nothing in article 3 above shall affect the continued operation of regulations(3) made under section 8 of the 1980 Act until those regulations are revoked by regulations made under that section as amended by paragraph 4 of Schedule 4 to the 1992 Act.

The Education (Schools) Act 1992 (Commencement No. 1) Order 1992 (S.I. 1992/1157) brought into force as respects England and Wales the following provisions of the 1992 Act: sections 1, 2(1), (2), (3)(a), (b) and (e) and (4) to (6), 3(1) and (3) to (5), 4, 5, 6(1), (2), (3)(a), (b) and (e) and (4) to (6), 7(1) and (3) to (5), 8, 10, 11, 12, 16, 18, 19and 20, Schedule 1, paragraphs 4and 5 of Schedule 2 and, so far as it relates to those provisions, section 9(7), Schedule 3, paragraphs 2, 3and (5) to (7) of Schedule 4 and, so far as it relates to those provisions, section 21(7) and, as regards the partial repeal of section 22 of the Education Reform Act 1988, Schedule 5 and, so far as it relates to that provision, section 21(8)
This Order brings into force on 1st May 1993 sections 14 and 17 of, paragraphs 1 to 3 of Schedule 2 to and, so far as it relates to those provisions, section 9(7) of, paragraph 4 of Schedule 4 to and, so far as it relates to those provisions, section 21(7) of the 1992 Act. Article 4, however, preserves the operation of regulations made under section 8 of the Education Act 1980 until regulations made under that section as amended by paragraph 4 of Schedule 4 to the 1992 Act come into force.
The Order also brings paragraphs 7 to 9 of Schedule 1 and paragraphs 2 and 3 of Schedule 4 to the 1992 Act into force in relation to Scotland.
The following Regulations are currently in force in relation to England: the Education (School Information) Regulations 1981, S.I. 1981/630, the Education (School Information) (Amendment) Regulations 1983, S.I. 1983/41, the Education (School Information) (Amendment) Regulations 1988, S.I. 1988/1023, the Education (School Hoursand Policies) (Information) Regulations 1989, S.I. 1989/398, the Education (School Curriculumand Related Information) Regulations 1989, S.I. 1989/954, the Education (School Records) Regulations 1989, S.I. 1989/1261, the Education (School Curriculumand Related Information) (Amendment) Regulations 1990, S.I. 1990/1109, the Education (Individual Pupils' Achievements) (Information) Regulations 1990, S.I. 1990/1381, the Education (Information on School Examination Results) (England) Regulations 1991, S.I. 1991/1265 (these Regulations have been revoked by the Education (School Performance Information) (England) Regulations 1992 except in so far as they amend the Education (School Information) Regulations 1981), the Education (School Curriculumand Related Information) (Amendment) Regulations 1991, S.I. 1991/1278, the Education (Pupils' Attendance Records) Regulations 1991,S.I. 1991/1582, the Education (School Information) (Amendment) (England) Regulations 1992, S.I. 1992/70, the Education (Individual Pupils' Achievements, School Recordsand School Curriculum) (Amendment) Regulations 1992, S.I. 1992/1089and the Education (School Performance Information) (England) Regulations 1992/1385.
The following Regulations are currently in force in relation to Wales: the Education (School Hours and Policies) (Information) Regulations 1989, S.I. 1989/398, the Education (School Records) Regulations 1989, S.I. 1989/1261, the Education (Pupils' Attendance Records) Regulations 1991, S.I. 1991/1582, the Education (School Curriculum and Related Information) (Wales) Regulations 1991, S.I. 1991/1658, the Education (School Curriculum and Related Information) (Amendment) (Wales) Regulations 1991, S.I. 1991/1813, the Education (School Performance Information) (Wales) Regulations 1992, S.I. 1992/2274 and the Education (Individual Pupils' Achievements) Regulations 1993, S.I. 1993/835. The Education (School Curriculum and Related Information) (Amendment) (Wales) Regulations 1993, S.I. 1993/998, made on 29th March 1993, will come into force on 6th May 1993.
