ARBITRATION

The Arbitration (Foreign Awards) Order 1993

The Queen’s Most Excellent Majesty in Council

Her Majesty, in pursuance of the powers conferred on Her by section 7(2) and (3) of the Arbitration Act 1975(1) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to declare, and it is hereby declared, as follows:

1.  This Order may be cited as the Arbitration (Foreign Awards) Order 1993 and shall come into force on 3rd June 1993.

2.  Antigua and Barbuda is a party to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards(2) which was adopted on 10th June 1958 and came into force in the United Kingdom of Great Britain and Northern Ireland on 23rd December 1975.

3.  The Arbitration (Foreign Awards) Order 1989(3) shall be amended by the deletion from the Schedule thereto of the words “Antigua and Barbados”.

Explanatory Note

(This note is not part of the Order)

This Order declares Antigua and Barbuda as a party to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. It had been intended to declare that country in the Arbitration (Foreign Awards) Order 1989 but that Order misdescribed it as “Antigua and Barbados” and Barbados itself is not a party to the Convention. Accordingly, the 1989 Order is amended by deleting the reference in the Schedule to Antigua and Barbados.
