Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Education (Provision of Information as to Schools) (Scotland) Regulations 1993, and shall come into force on 2nd August 1993.

(2) In these Regulations, unless the context otherwise requires–

“school year” means a period of 12 months commencing on 1st August of any year;

“special school” does not include a special class, or unit, forming part of a school.

Information to be provided and to whom

2.—(1) Every education authority, in respect of each school for the management of which they are responsible and to which any of paragraphs 1 to 7 of the Schedule hereto applies, shall provide to the Secretary of State as regards that school and the pupils attending it the information specified in that paragraph.

(2) The managers of an independent school to which any of paragraphs 2, 3, 4, 5 or 7 of the Schedule hereto applies shall provide to the Secretary of State as regards that school and the pupils attending it the information specified in that paragraph.

(3) The managers of a grant-aided school to which any of paragraphs 1 to 7 of the Schedule hereto applies shall provide to the Secretary of State as regards that school and the pupils attending it the information specified in that paragraph.

When and form in which information to be provided

3.—(1) The information specified in paragraph 1 of the Schedule hereto shall be provided in writing by 15th September 1994 and by 15th September in each calendar year thereafter.

(2) The information specified in paragraphs 2, 3, 4, 6 and 7 of that Schedule shall be provided in writing by 15th September 1993 and by 15th September in each calendar year thereafter.

(3) The information specified in paragraph 5 of that Schedule shall be provided in writing by 30th October 1993 and by 30th October in each calendar year thereafter.
