The Minister of Agriculture, Fisheries and Food in exercise of the powers conferred by section 26(1) of the Animal Health Act 1981(1) and the said Minister, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by sections 1, 7(1), 8(1), 15(4), 17(1), 23, 25, 38(1), 83(2) and 87(2) of the said Act and of all other powers enabling them in that behalf, hereby make the following Order:

Title and commencement

1.  This Order may be cited as the Foot–and–Mouth Disease (Amendment) (No. 2) Order 1993 and shall come into force on 1st January 1994.

Amendments

2.—(1) In the Foot–and–Mouth Disease Order 1983(2) for articles 22A and 34A there shall be substituted the following articles respectively—

Requirement to confine animals on common land within an infected area in England or Wales

22A.  The owner or person in charge of an animal allowed to run on common or unenclosed land in England or Wales shall, upon the making of a declaration under article 17 of this Order in relation to that land, confine that animal within premises in the infected area., and

Requirement to confine animals on common land within a controlled area in England or Wales

34A.  The owner or person in charge of an animal allowed to run on common or unenclosed land in England or Wales shall, upon the making of a declaration under article 30 of this Order in relation to that land, confine that animal within premises in the controlled area..

(2) In the Swine Vesicular Disease Order 1972(3) for the Schedule to that Order there shall be substituted the Schedule set out in the Schedule to this Order.

(3) In the African Swine Fever Order 1980(4)—

(a)in article 3 the words “to the extent indicated in the third column of that Schedule” shall be deleted, and

(b)for the Schedule to that Order there shall be substituted the Schedule set out in the Schedule to this Order.

3.  The Foot–and–Mouth Disease (Amendment) Order 1993(5) is hereby revoked.

Explanatory Note

(This note does not form part of the Order)

This Order amends the Foot–and–Mouth Disease Order 1983 so as to make provision for the confinement of animals running on unenclosed land in the event of an outbreak of the disease in that area. It also makes a consequential amendment to the Swine Vesicular Disease Order 1972 and the African Swine Fever Order 1980. It revokes the Foot–and– Mouth Disease (Amendment) Order 1993.

A Compliance Cost Assessment has been made and a copy has been placed in the library of the House.
