CHANGES IN LOCAL GOVERNMENT AREAS

The Stirling and Clackmannan Districts (Blackgrange and Blairlogie House) Boundaries Amendment Order 1993

Whereas under section 17(1) of the Local Government (Scotland) Act 1973(1) the Local Government Boundary Commission for Scotland on 9th May 1990 submitted to the Secretary of State a report on a review conducted under section 14(2) of that Act in which they made proposals for the transfer of certain areas from Stirling District to Clackmannan District, both in Central Region, and in which they also made proposals for changes in electoral arrangements consequential on those changes in local government areas;

Now, therefore, in exercise of the powers conferred on him by section 17(2) of the said Act, and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order to give effect to the proposals of the Local Government Boundary Commission for Scotland as submitted to him:

Citation and commencement

1.  This Order may be cited as the Stirling and Clackmannan Districts (Blackgrange and Blairlogie House) Boundaries Amendment Order 1993, and shall come into force on 1st April 1993.

Interpretation

2.  In this Order:—

“the 1977 Regulations” means the Local Government Area Changes (Scotland) Regula tions 1977(2); and

“boundary map” means the map prepared by The Scottish Office marked “The Stirling and Clackmannan Districts (Blackgrange and Blairlogie House) Boundaries Amend ment Order 1993” and deposited in accordance with regulation 3 of the 1977 Regulations;

and, in the Schedule to this Order, any reference to a district boundary is a reference to such a boundary as it exists immediately before the commencement of this Order.

Application of the 1977 Regulations

3.  Save insofar as they can have no application in relation to the area changes effected by this Order, the provisions of the 1977 Regulations shall apply in relation thereto for the purposes of, or in consequence of, this Order.

Area changes

4.—(1) That part of Stirling District in Central Region at Blairlogie House, being the Area A described in Part I of the Schedule to this Order and shown delineated, hatched and marked area “A” on the boundary map, shall be transferred to Clackmannan District in Central Region.

(2) Those parts of Stirling District in Central Region at the A907 road, being the Areas B and C described in Part II of the Schedule to this Order and shown delineated, hatched and marked respectively areas “B” and “C” on the boundary map, shall both be transferred to Clackmannan District in Central Region.

Consequential changes in electoral arrangements

5.—(1) Area A described in the Schedule to this Order (being the Area A transferred by article 4(1) of this Order)—

(a)shall cease to form part of electoral division 15 (Airthrey) of Central Region(3) and of ward 18 (Logie) of Stirling District(4); and

(b)shall form part of electoral division 6 (Ochil) of Central Region and ward 12 (Menstrie) of Clackmannan District(5).

(2) Each of Areas B and C described in the Schedule to this Order (being the Areas B and C transferred by article 4(2) of this Order)—

(a)shall cease to form part of electoral division 15 (Airthrey) of Central Region and ward 18 (Logie) of Stirling District; and

(b)shall form part of electoral division 3 (Tullibody) of Central Region and ward 5 (Baingle) of Clackmannan District.

SCHEDULEPART I

Area A

The area bounded by a line commencing at a point on the Stirling/Clackmannan district boundary (Grid Reference NS83599683) westwards along the north side of the A91 road to the point at which it meets the south side of the access track to Dumyat Farm (Grid Reference NS83449683); then northeastwards by the north face of the fence running parallel to the said access track to the point at which it meets the district boundary (Grid Reference NS83669695); then generally southwestwards along that boundary to the point of commencement. PART II

Area B

The area bounded by a line commencing at a point on the Stirling/Clackmannan district boundary (Grid Reference NS84659517) westwards along the north side of the A907 road to the point at which it meets the district boundary (Grid Reference NS84509517); then generally southeastwards along that boundary to the point of commencement.

Area C

The area bounded by a line commencing at a point on the Stirling/Clackmannan district boundary (Grid Reference NS83879513) westwards along the north side of the A907 road to a point (Grid Reference NS83399516); then southwards across the said road to the point at which it meets the district boundary (Grid Reference NS83389515); then eastwards along that boundary to the point of commencement.

Explanatory Note

(This note is not part of the Order)

This Order transfers from Stirling to Clackmannan District both in Central Region on 1st April 1993 three areas amounting in total to approximately 2.2 hectares and makes consequential changes to electoral arrangements.

The map annexed to and forming part of this note gives a general guide to the areas affected by this Order.

Copies of the detailed boundary map defined in article 2 of this Order may be inspected at the offices of any of the local authorities referred to in this Order, and may be inspected at or purchased from the Scottish Office Environment Department’s Map Library, New St Andrew’s House, Edinburgh, EH1 3TG.
