The A23 Trunk Road (Brighton Road, Croydon) (Box Junction) Order 1993

The Secretary of State for Transport, in exercise of the powers conferred by sections 6(1) and (3) and 7(1) of the Road Traffic Regulation Act 1984(1), and of all other enabling powers, and after consulting the Commissioner of Police of the Metropolis pursuant to section 7(6) of that Act(2), hereby makes the following Order:

1.  This Order may be cited as the A23 Trunk Road (Brighton Road, Croydon) (Box Junction) Order 1993 and shall come into force on 13th January 1993.

2.  In this Order—

“boxed area” means the area of the carriageway of the trunk road specified in the Schedule to this Order, being an area of the said carriageway which is marked by the traffic sign specified in diagram 1044 in the Traffic Signs Regulations and General Directions 1981(3); and

“the trunk road” means that part of the A23 Trunk Road in the London Borough of Croydon known as Brighton Road.

3.  Save as provided in article 4 below, no person shall cause or permit any vehicle to enter the boxed area if it would become necessary for the whole or any part of the vehicle to remain stationary within that area due to the presence of other stationary vehicles.

4.  The provisions of article 3 above shall not apply—

(a)in respect of a vehicle being used for police, fire brigade or ambulance purposes;

(b)to anything done with the permission or at the direction of a police constable in uniform or of a traffic warden; or

(c)so as to render it unlawful to cause or permit the whole or any part of a vehicle to remain stationary in the boxed area if, when the whole or any part of the vehicle entered that area, the person so causing or permitting had reason to believe that he would immediately be able to cause or permit the vehicle to be driven out of that area.

SCHEDULE

The area of the trunk road marked with the traffic sign referred to in article 2 above which is in the trunk road at its junction with Lion Green Road, Coulsdon (A327).
