The Rules of the Air (Second Amendment) Regulations 1993

The Secretary of State for Transport, in exercise of his powers under article 69(1) of the Air Navigation Order 1989(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

1.  These Regulations may be cited as the Rules of the Air (Second Amendment) Regulations 1993 and shall come into force on 1st April 1993.

2.  The Schedule to the Rules of the Air Regulations 1991(2) shall be amended as follows:

(1) For rule 5(2)(b) there shall be substituted:

(b)Paragraphs (1)(a)(ii), (1)(c), (1)(d) and (1)(e) shall not apply to an aircraft flying under and in accordance with the terms of a police air operator’s certificate..

(2) At the end of rule 17(1) there shall be added:

  • Provided that subparagraphs (c) and (e) of this paragraph shall not apply to an aircraft which is flying under and in accordance with the terms of a police air operator’s certificate..

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Rules of the Air Regulations 1991. The changes are:

(1) Rule 5 is amended so as to exclude from a number of specified provisions aircraft flying in accordance with a police air operator’s certificate (regulation 2(1)).

(2) An aircraft flying in accordance with a police air operator’s certificate does not need the agreement of the commander of any other aircraft to fly in formation with that aircraft and does not need to maintain its course and speed if it has the right of way (regulation 2(2)).
