The Secure Tenancies (Designated Courses) (Amendment) Regulations 1993

The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by paragraph 10 of Schedule 1 to the Housing Act 1985(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:—

Citation and commencement

1.  These Regulations may be cited as the Secure Tenancies (Designated Courses) (Amendment) Regulations 1993 and shall come into force on 1st April 1993.

Amendment

2.  The Secure Tenancies (Designated Courses) Regulations 1980(2) are amended as follows:—

(a)at the end of regulation 2(b) omit “and”; and

(b)at the end of regulation 2 insert—

(d)any full-time course at an establishment within the further education sector (within the meaning of section 91(3) of the Further and Higher Education Act 1992); and

(e)any full-time course at an establishment within the higher education sector (within the meaning of section 91(5) of the Further and Higher Education Act 1992), other than a university.(3).

Explanatory Note

(This note is not part of the Regulations)

Under paragraph 10 of Schedule 1 to the Housing Act 1985, a tenancy is not, for a specified period, a secure tenancy if it is granted for the purposes of enabling a student to attend a designated course at an educational establishment and the notification requirements of that paragraph have been satisfied.

These Regulations amend the Secure Tenancies (Designated Courses) Regulations 1980 by additionally designating full-time courses at establishments within the higher or further education sectors.They are consequential on the Further and Higher Education Act 1992.
