The Education (National Curriculum) (Modern Foreign Languages) (Amendment) Order 1994

In exercise of the powers conferred on the Secretary of State by sections 3(2)(b) and 232(5) and (6) of the Education Reform Act 1988(1) the Secretary of State for Education, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Order:
1. This Order may be cited as the Education (National Curriculum) (Modern Foreign Languages) (Amendment) Order 1994 and shall come into force on 1st August 1994.
2. There shall be substituted for article 3(1) of the Education (National Curriculum) (Modern Foreign Languages) Order 1991(2), the following paragraph:
“(1) Subject to paragraph (2), in the case of schools in England the modern foreign languages listed in the Schedule to this Order are hereby specified as foundation subjects in relation to the third and fourth key stages, and in the case of schools in Wales those modern foreign languages are hereby specified as foundation subjects in relation to the third key stage.”.

Explanatory Note
(This note is not part of the Order)
The Education (National Curriculum) (Foundation Subjects at Key Stage 4) Order 1994 (S.I. 1994/1814) amends the Education Reform Act 1988 so that in relation to the fourth key stage a modern foreign language specified in an Order of the Secretary of State ceases to be a foundation subject in England until 1st August 1996 and ceases to be a foundation subject completely in Wales.
The modern foreign languages which are foundation subjects comprised in the National Curriculum at the third and fourth key stages are specified by the Education (National Curriculum) (Modern Foreign Languages) Order 1991. That Order applies to pupils in both England and Wales. The present Order makes consequential amendments to the 1991 Order.
