The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by sections 1, 10, and 87(5)(a) of the Animal Health Act 1981(1), and of all other powers enabling them in that behalf, hereby make the following Order:
1. This Order may be cited as the Importation of Animal Products and Poultry Products (Amendment) Order 1994 and shall come into force on 14th December 1994.
2.—(1) The Importation of Animal Products and Poultry Products Order 1980(2) is hereby amended in accordance with this article.
(2) For article 2(a) of that Order (definition of poultry) there shall be substituted the following provision:
“(a)the definition of the expression “poultry” in section 87(4) of the 1981 Act is hereby extended so as to comprise all birds, and”.
(3) In article 3 (interpretation) for the definition of “animal product” there shall be substituted the following definition:
““animal product” means anything originating or made (whether in whole or in part) from a living or dead animal and includes the carcase or any part of the carcase of an animal, but does not include ova, semen or embryos;”.
(4) In article 3 for the definition of “poultry product” there shall be substituted the following definition:
““poultry product” means anything originating or made (whether in whole or in part) from living or dead poultry and includes the carcase or any part of the carcase of poultry, but does not include semen or hatching eggs.”.
(5) The following Schedule shall be substituted for the Schedule to the Order:
Article 4(5)
Substances subject to the provisions of the Medicines Act 1968(3).
Animal pathogens or carriers as defined in the Importation of Animal Pathogens Order 1980(4) whether or not the pathogen or carrier is imported from outside the European Economic Area.”.
3. The Importation of Embryos, Ova and Semen Order 1980(5) is hereby amended by substituting for article 2(a) (extension of the definition of poultry and disease) the following:
“(a)the definition of the expression “poultry” in section 87(4) of the Animal Health Act 1981 is hereby extended so as to comprise all birds, and”.
4. The Importation of Animal Products and Poultry Products (Amendment) Order 1980(6) and the Importation of Animal Products and Poultry Products (Amendment) Order 1981(7) are hereby revoked.

This Order amends the Importation of Animal Products and Poultry Products Order 1980 so as to extend the prohibition of landing animal products or poultry products without a licence. The prohibition now covers all animal products and poultry products other than those covered in specific legislation listed in the Schedule.
It also amends the Importation of Embryos, Ova and Semen Order 1980 so as to extend the definition of “poultry” in that Order to all birds.
It revokes the Importation of Animal Products and Poultry Products (Amendment) Order 1980 (S. I. 1980/1934) and the Importation of Animal Products and Poultry Products (Amendment) Order 1981 (S. I. 1981/1238).
