Whereas the Secretary of State for Education, in accordance with section 51(3) of the Further and Higher Education Act 1992(1) and regulation 7 of the Education (Publication of Draft Proposals and Orders) (Further Education Corporations) Regulations 1992(2) has published a draft of this Order by the time and in the manner prescribed by that regulation;
And whereas it appears to the Secretary of State that the educational institution known as Margaret Danyers College falls within section 16(2)(b) of that Act;
Now therefore, in exercise of the powers conferred on her by sections 16(2) and 17 of the Act the Secretary of State for Education hereby makes the following Order:
1. This Order may be cited as the Margaret Danyers College (Incorporation) Order 1994 and shall come into force on 1st January 1995 (“the Commencement Date”).
2. On the Commencement Date there shall be established a body corporate called “Margaret Danyers College” for the purpose of conducting from the operative date the existing educational institution of that name.
3. The “operative date” in relation to the further education corporation established by this Order shall be 1st August 1995, and the corporation shall conduct Margaret Danyers College from that date.

This Order establishes a further education corporation under section 16(2) of the Further and Higher Education Act 1992 for the purpose of conducting Margaret Danyers College and appoints 1st August 1995 as the “operative date” for the purposes of Part I of that Act.
