The Secretary of State for the Environment as respects England and the Secretary of State for Wales as respects Wales, in exercise of the powers conferred on them by sections 173, 175(1A) and 270(1) of the Local Government Act 1972(1), sections 18 and 190(1) of the Local Government and Housing Act 1989(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Local Authorities (Members' Allowances) (Amendment) Regulations 1994 and shall come into force on 1st April 1994 (“the commencement day”).

Increase of allowances

2.—(1) The Local Authorities (Members' Allowances) Regulations 1991(3) shall be amended as follows.

(2) In regulation 12(c) (special responsibility allowance), for “£8,120” there shall be substituted, in relation to any year beginning on or after the commencement day, “£8,291”.

(3) In regulation 17(2) (allowance in respect of conferences and meetings) for “£24.70” there shall be substituted, in relation to attendance at a conference or meeting on or after the commencement day, “£25.20”.

(4) In regulation 18(1) (attendance allowance) for “£24.70” there shall be substituted, in respect of an approved duty performed on or after the commencement day, “£25.20”.

(5) In regulation 18(2) (financial loss allowance), in respect of an approved duty performed on or after the commencement day—

(a)in paragraph (a) for “£21.00” there shall be substituted “£21.45”; and

(b)in paragraphs (b) and (c), for “£42.00” there shall be substituted “£42.90”.

(6) For the Table in the Schedule, in relation to a year beginning on or after the commencement day, there shall be substituted the following—

Revocation

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Local Authorities (Members' Allowances) Regulations 1991.

They increase the amounts by reference to which a ceiling is imposed in Part III of those Regulations in relation to schemes, under section 18 of the Local Government and Housing Act 1989, for the payment of basic, special responsibility and attendance allowances (regulation 2(6)). They also increase the amount of special responsibility allowance under such a scheme which a member may be paid in any year (regulation 2(2)).

The maximum amount of attendance allowance payable to parish and community councillors under the Local Government Act 1972 is also increased (regulation 2(4)), as is the maximum financial loss allowance payable both to those councillors and to non-elected members of local authorities (regulation 2(5)).

The amount payable by way of allowance under section 175 of that Act in respect of attendance at conferences and meetings by members of local authorities is also increased (regulation 2(3)).

All the amounts are increased by 2.1 per cent.

1972 c. 70. Section 173 was amended by the Local Government, Planning and Land Act 1980 (c. 65), section 24(1), and by the Local Government and Housing Act 1989 (c. 42), Schedule 11 paragraph 26. Section 175(1A) was inserted by paragraph 27 of Schedule 11 to the 1989 Act. “Prescribed” is defined in section 270(1) of the 1972 Act.
