The Secretary of State for Transport, in exercise of the powers conferred by sections 25(1) and 60(2) of the Public Passenger Vehicles Act 1981(1) and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 61(2) of that Act, hereby makes the following Regulations:—
1. These Regulations may be cited as the Public Service Vehicles (Conduct of Drivers, Inspectors, Conductors and Passengers) (Amendment) Regulations 1995 and shall come into force on 1st March 1995.
2.—(1) The Public Service Vehicles (Conduct of Drivers, Inspectors, Conductors and Passengers) Regulations 1990(2) shall be amended as follows.
(2) In regulation 6(1), for sub-paragraph (g) there shall be substituted the following sub-paragraph—
“(g)speak to the driver whilst the vehicle is in motion except—
(i)in an emergency;
(ii)for reasons of safety; or
(iii)to give directions as to the stopping of the vehicle;.”

These Regulations amend the Public Service Vehicles (Conduct of Drivers, Inspectors, Conductors and Passengers) Regulations 1990 so that passengers on a public service vehicle are not prohibited by those Regulations from speaking to the driver when the vehicle is not in motion.
1981 c. 14. Section 25 was amended by the Transport and Works Act 1992 (c. 42) section 61, section 60(2) was amended by the Transport Act 1985 (c. 67) section 134(2) and section 61(2) was amended by the Transport Act 1985 section 135(1) and Schedule 8.
