Whereas the Secretary of State has received notification from the Independent Television Commission in accordance with section 177(2) of the Broadcasting Act 1990(1) of details of the foreign satellite service known as XXX TV Erotica and formerly known as TV Erotica together with their reasons why they consider that service to be unacceptable and why they consider that an Order under section 177 of that Act should be made:
And whereas the Secretary of State, having received such notification, is satisfied that the making of such an order is in the public interest and compatible with any international obligations of the United Kingdom:
Now, therefore, the Secretary of State, in exercise of the powers conferred on her by section 177 of the Broadcasting Act 1990, hereby makes the following Order:
1. This Order may be cited as the Foreign Satellite Service Proscription Order 1995 and shall come into force on 5th December 1995.
2. The foreign satellite service which at the date of making this Order is known as XXX TV Erotica and which was formerly known as TV Erotica is hereby proscribed for the purposes of section 178 of the Broadcasting Act 1990.

Section 177 of the Broadcasting Act 1990 empowers the Secretary of State to make orders proscribing unacceptable foreign satellite services for the purposes of section 178 of that Act. This Order proscribes the foreign satellite service known as XXX TV Erotica formerly known as TV Erotica. Section 178 provides that various acts in support of a proscribed service shall be criminal offences.
