The Lord Chancellor, in exercise of the powers conferred on him by section 94(2) and (5) of the Police and Magistrates' Courts Act 1994(1), hereby makes the following Order—

1.—(1) This Order may be cited as the Police and Magistrates' Courts Act 1994 (Commencement No. 6 and Transitional Provisions) Order 1995.

(2) This Order shall come into force on 3rd February 1995.

2.  Subject to article 3, paragraph 19(1) and (2) of Schedule 8 to the Police and Magistrates' Courts Act 1994 (amendments of section 59(1) of the Justices of the Peace Act 1979(2)) shall come into force by virtue of this Order.

3.  Section 59(1) of the Justices of the Peace Act 1979 as amended by paragraph 19(1) and (2) of Schedule 8 of the Police and Magistrates' Courts Act 1994 shall apply as regards the net cost to a responsible authority in any year of its functions under the Justices of the Peace Act 1949 (Compensation) Regulations 1978(3) only in respect of decisions on claims for compensation made by a determining authority under those Regulations on or after 3rd February 1995.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 3rd February 1995 paragraph 19(1) and (2) of Schedule 8 of the Police and Magistrates' Courts Act 1994 which amends section 59(1) of the Justices of the Peace Act 1979. This enables grant to be paid by the Lord Chancellor under that subsection to local authorities in respect of compensation for loss of office or employment or loss or diminution of emoluments by justices' clerks and their assistants under the Justices of the Peace Act 1949 (Compensation) Regulations 1978. Under transitional provisions in article 3, grant is to be payable only in respect of decisions made on compensation claims by a determining authority (the appropriate magistrates' courts committee) on or after 3rd February 1995.
