Citation, commencement, interpretation and extent

1.—(1) This Order may be cited as the Education (National Curriculum) (Attainment Targets and Programmes of Study in Welsh) Order 1995 and shall come into force in accordance with articles 2 to 6.

(2) In this Order—

“the Document” means the document published in January 1995 by Her Majesty’s Stationery Office entitled “Welsh in the National Curriculum”(1);

reference to the first, second, third and fourth key stages are references to the periods set out in paragraphs (a) to (d) respectively of section 3(3) of the Education Reform Act 1988(2);

references to a Welsh–speaking school are references to such a school as defined by section 3(7) of the Education Reform Act 1988.

(3) This Order applies to schools in Wales only.

2.  The provisions of this Order relating to the first key stage shall come into force on 1st August 1995.

3.—(1) Except where paragraph (2) or (3) applies, the provisions of this Order relating to the second key stage shall come into force on 1st August 1995, subject, however, to article 6 below.

(2) This paragraph applies in the case of a school if, in relation to the first year of the second key stage, Welsh was not taught (whether as a first or a second language) in the curriculum in either the school year commencing in 1987 or in the school year commencing in 1988.

(3) This paragraph applies in the case of a school to which paragraph (2) does not apply if, in the school year commencing in 1990 less than half of the total number of pupils in the first year of the second key stage in the school were taught Welsh in the curriculum in both the school year commencing in 1988 and the school year commencing in 1989.

(4) Where paragraph (2) or (3) above applies this Order so far as it relates to the second key stage shall come into force—

(a)on 1st August 1995 in respect of pupils in the first and second years of that key stage;

(b)on 1st August 1996 in respect of pupils in the third year of that key stage; and

(c)on 1st August 1997 in respect of pupils in any subsequent year of that key stage.

4.  The provisions of this Order relating to the third key stage shall come into force on 1st August 1995 subject, however, to article 6 below.

5.—(1) Subject to paragraph (2), the provisions of this Order relating to the fourth key stage shall come into force—

(a)in the case of pupils at Welsh–speaking schools—

(i)on 1st August 1996 in respect of pupils in the first year of that key stage; and

(ii)on 1st August 1997 in respect of all other pupils; and

(b)in the case of pupils at schools which are not Welsh–speaking schools—

(i)on 1st August 1999 in respect of pupils in the first year of that key stage; and

(ii)on 1st August 2000 in respect of all other pupils.

(2) This article does not apply in the case of a pupil in the fourth key stage at a school specified in Schedule 5.

6.—(1) This article shall apply in the case of a school specified in Schedules 1 to 4 (“a specified school”) and, for the purposes thereof, in relation to a specified school, any reference to the relevant Schedule or Part is respectively a reference to the Schedule or Part of a Schedule in which it is specified.

(2) In relation to a specified school, this Order, so far as it relates to a key stage specified in the relevant Schedule or Part, shall come into force in respect of pupils in a year of that key stage so specified on the date specified opposite thereto in the relevant Schedule or Part.

Revocation

7.  The Education (National Curriculum) (Attainment Targets and Programmes of Study in Welsh) Order 1990(3), the Education (National Curriculum) (Attainment Targets and Programmes of Study in Welsh) (Amendment) Order 1991(4), the Education (National Curriculum) (Attainment Targets and Programmes of Study in Welsh) (Amendment) Order 1992(5) and the Education (National Curriculum) (Attainment Targets and Programmes of Study in Welsh) (Amendment) (No. 2) Order 1992(6) shall cease to apply—

(a)on 1st August 1995 in respect of pupils in the first, second and third key stages;

(b)on 1st August 1996 in respect of pupils in the first year of the fourth key stage; and

shall be revoked on 1st August 1997.

Specification of attainment targets and programmes of study

8.  It is hereby directed that the provisions relating to attainment targets and programmes of study set out in the Document shall have effect for the purposes of specifying attainment targets and programmes of study in relation to Welsh.

9.  The examples printed in italics in the Document (which serve to illustrate the programmes of study described therein) do not form part of the provision made by this Order.
