Regulations 2(2) and 6(2)(c)
1. The CE conformity marking shall consist of the initials `CE' taking the following form:
2. If the marking is reduced or enlarged, the proportions given in the above graduated drawing must be respected.
3. The various components of the CE marking must have substantially the same vertical dimension, which may not be less than 5 mm.
This minimum dimension may be waived for small-scale equipment, protective systems or devices referred to in Article 1(2).
4. The CE marking shall be followed by the identification number of the notified body where such body is involved in the production control stage.
5. The CE marking shall be affixed distinctly, visibly, legibly and indelibly to equipment and protective systems, supplementary to the provisions of point 1.0.5 of Annex II(1).
6. Subject to paragraph 7 below, where equipment, a protective system or device is the subject of other Community Directives covering other aspects and which also provide for the affixing of the CE marking, such marking shall indicate that the equipment, protective system or device in question is also presumed to conform with the provisions of those other Directives.
7. Where one or more of the other Directives referred to in paragraph 6 above allow the manufacturer, during a transitional period, to choose which arrangements to apply, the CE marking shall indicate conformity only with the Directives applied by the manufacturer. In this case, particulars of the Directives applied, as published in the Official Journal of the European Communities, must be given in the documents, notices or instructions required by the Directives and accompanying such equipment, protective system or device.
8. Where equipment or protective systems are designed for a particular explosive atmosphere, they must be marked accordingly.
9. The affixing of markings on the equipment or protective systems which are likely to deceive third parties as to the meaning and form of the CE marking shall be prohibited. Any other marking may be affixed to the equipment or protective systems, provided that the visibility and legibility of the CE marking is not thereby reduced.
This is a reference to point 1.0.5 of the Essential Health and Safety Requirements contained in Annex II (of the ATEX Directive) which is set out in Schedule 3.
