Whereas the Secretary of State for Education and Employment has received a proposal from the Further Education Funding Council for England, made in accordance with section 51 of the Further and Higher Education Act 1992(1) (“the Act”), for the dissolution under section 27 of the Act of the further education corporations known as Brunel College of Arts and Technology and South Bristol College(2) (“the Old Corporations”);

Now therefore in exercise of the power conferred on her by section 27 of the Act the Secretary of State after consulting the Old Corporations and with the consent of the further education corporation known as City of Bristol College(3) (“the New Corporation”) hereby makes the following Order:

1.  This Order may be cited as The Brunel College of Arts and Technology and South Bristol College (Dissolution) Order 1996 and shall come into force on 1st September 1996.

2.  On 1st September 1996 the Old Corporations shall be dissolved and all of their respective property, rights and liabilities shall be transferred to the New Corporation, being a body corporate established for purposes which include the provision of educational facilities or services.

3.  Section 26(2), (3) and (4) of the Act shall apply to any person employed by either of the Old Corporations immediately before 1st September 1996 as if the references in that section—

(a)to a person to whom that section applies were to a person so employed;

(b)to the operative date were to 1st September 1996;

(c)to the transferor were to either of the Old Corporations (as the case may be); and

(d)to the corporation were to the New Corporation.

Explanatory Note

(This note is not part of the Order)

This Order dissolves the further education corporations established to conduct Brunel College of Arts and Technology and South Bristol College. It provides that the property, rights and liabilities of the two colleges transfer to City of Bristol College and secures the rights of its employees by applying section 26(2) to (4) of the Further and Higher Education Act 1992.

Established by the Education (Further Education Corporations) Order 1992 (S.I. 1992/2097). The name of Brunel College of Technology, Bristol was changed to Brunel College of Arts and Technology on 1st April 1993.
