Whereas the Secretary of State is a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the safety of ships and the health and safety of person on them;
And whereas, in so far as the following Regulations are made in exercise of powers conferred by section 85 of the Merchant Shipping Act 1995(3), the Secretary of State has in pursuance of subsection (4) of section 86 of the said Act consulted the persons referred to in that subsection;
Now therefore the Secretary of State, in exercise of the powers conferred on him by:
the said section 2(2);
sections 85(1)(a) and (3) and (5) to (7) and 86(1) of the Merchant Shipping Act 1995;
section 103(3) of the Medicines Act 1968(4);
and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Merchant Shipping and Fishing Vessels (Medical Stores) (Amendment) Regulations 1996 and shall come into force on 5th December 1996.
2. In the Table in regulation 4(1) of the Merchant Shipping and Fishing Vessels (Medical Stores) Regulations 1995(5) for the words “no more than 30 nautical miles from” in Column 1, entry 3 there shall be substituted the words “very close to”.

These Regulations amend the Merchant Shipping and Fishing Vessels (Medical Stores) Regulations 1995. The amendment adopts the wording of Council Directive 92/29/EEC of 31st March 1992 (O.J. No. L113, 30.4.92, p. 19), which the 1995 Regulations implement, in defining the area of operation for vessels carrying category C stores as “very close to shore”.
