The Secretary of State, in exercise of the powers conferred on her by sections 29 and 60(5) of the National Lottery etc. Act 1993(1), and of all other powers enabling her in that behalf, hereby makes the following Order:
1. This Order may be cited as the National Lottery etc. Act 1993 (Amendment of Section 23) Order 1996 and shall come into force on 1st January 1997.
2. Section 23(2)(a) of the National Lottery etc. Act 1993 (distributing bodies for sums allocated for expenditure on or connected with sport) shall be amended by substituting “the English Sports Council” for “the Sports Council”.
3. Sums that apart from this Order would be held in the Distribution Fund for distribution by the Sports Council shall be held in the Distribution Fund for distribution by the English Sports Council.

This Order amends section 23(2)(a) of the National Lottery etc. Act 1993 by substituting the English Sports Council for the Sports Council. The English Sports Council is an incorporated body established by Royal Charter.
The Order also makes provision relating to sums held in the National Lottery Distribution Fund.
