Explanatory Note

(This note is not part of the Order)

This Order amends, with respect to England and Wales only, section 4 of the Housing Associations Act 1985, which sets out the conditions of eligibility of housing associations for registration under the Act.

A new permissible purpose or object is inserted, of disposing of houses to residents of the association in question at less than the market value. In addition, an existing purpose or object relating to assisting residents to acquire houses or procure the construction of houses is amended. The amendments remove the restrictions that prevent the houses in question being those of the association or constructed on the association’s land.

(2)

1985 c. 69. This section was amended by the Housing Act 1988, section 48(1), and by the Housing Associations (Permissible Additional Purposes) (England and Wales) Order 1994, S.I. 1994/2895.
