The Secretary of State, in exercise of the powers conferred on him by section 10(4) of the Local Government, Planning and Land Act 1980(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Local Government (Direct Labour Organisations) (Accounts) (Scotland) Regulations 1996 and shall come into force on 1st April 1996.
2. Section 10(2) of the Local Government, Planning and Land Act 1980(2) as it applies to Scotland is amended as follows—
(a)by substituting for paragraph (a) the following paragraphs—
“(a)general highway works on a trunk road;
(aa)general highway works on a road other than a trunk road;”; and
(b)by inserting at the end the words “, and in this subsection “trunk road” has the meaning given in section 151(1) of the Roads (Scotland) Act 1984(3)”.

Local authorities who undertake construction or maintenance work are required by section 10(1) of the Local Government, Planning and Land Act 1980 to keep separate accounts in respect of each description of work in section 10(2) of the Act. These Regulations further amend the descriptions of construction or maintenance work in section 10(2) so as to distinguish in Scotland between trunk roads and roads other than trunk roads. The previous amendment to section 10(2) for Scotland was made by the Local Government (Direct Labour Organisations) (Accounts) (Scotland) Regulations 1982 (S.I. 1982/319) which provides a separate description for general water and sewerage work.
