The Minister of Agriculture, Fisheries and Food and the Secretaries of State respectively concerned with sea fishing in Scotland, Wales and Northern Ireland, in exercise of the powers conferred on them by section 30(2) of the Fisheries Act 1981(1), and of all other powers enabling them in that behalf, hereby make the following Order:

Title and commencement

1.  This Order may be cited as the Third Country Fishing (Enforcement) (Amendment) Order 1997 and shall come into force on 4th July 1997.

Amendment of the Third Country Fishing (Enforcement) Order 1997

2.  The Schedule to the Third Country Fishing (Enforcement) Order 1997(2) shall be amended as follows:

(a)in paragraph 1, in column 1, after the words “flying the flag of Norway” there shall be inserted the words “as amended by Council Regulation (EC) No 1131/97(3)”;

(b)in paragraph 2, in column 1, after the words “flying the flag of the Faroe Islands” there shall be inserted the words “as amended by Council Regulation (EC) No 1132/97(4)”.

Explanatory Note

(This note is not part of the Order)

This Order amends the Third Country Fishing (Enforcement) Order 1997 (“the principal Order”), which provides for the enforcement of certain of the enforceable Community restrictions and other obligations relating to sea fishing set out in Council Regulation (EC) No. 391/97 and Council Regulation (EC) No. 393/97 (“the Community Regulations”). The Community Regulations authorise fishing by vessels of Norway and the Faroe Islands for specified descriptions of fish in certain specified areas within member States' fishery limits in 1997. The Order makes certain amendments to the Schedule to the principal Order in consequence of changes to the Community Regulations which provide for vessels from these two countries to fish for herring in ICES division IIA.
