The Secretary of State for Health, in exercise of powers conferred by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the management of hospitals, establishments and facilities previously managed by the former Sandwell Health Authority resulting from the establishment of the University Hospital Birmingham National Health Service Trust(2), having consulted the Sandwell Health Authority(3) and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the University Hospital Birmingham National Health Service Trust (Transfer of Trust Property) Order 1997 and shall come into force on 14th March 1997.

(2) In this Order—

“the Authority” means the Sandwell Health Authority;

“the Trust” means the University Hospital Birmingham National Health Service Trust;

“the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the Authority and the Trust on 22nd July 1996, which schedule has been signed on behalf of both the Authority and the Trust.

Transfer of trust property

2.  On 14th March 1997 the trust property shall be transferred from the Authority to the Trust.

Explanatory Note

(This note is not part of the Order)

This Order transfers to the University Hospital Birmingham National Health Service Trust on 14th March 1997 trust property held by the Sandwell Health Authority. A copy of the schedule of trust property to which the Order refers can be obtained from the Department of Health, National Health Service Trust Finance Team, Room 1N33F, Quarry House, Quarry Hill, Leeds LS2 7UE.
