The Secretary of State in exercise of the powers conferred on him by section 43B(1) of the National Lottery etc. Act 1993(1), and having consulted such persons as appear to him appropriate(2), hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the New Opportunities Fund (Specification of Initiatives) Order 1998 and shall come into force on 24th July 1998.

Specification of initiatives

2.  For the purposes of section 43B(1) of the National Lottery etc. Act 1993 the initiatives set out in article 3 are specified.

3.—(1) An initiative to provide facilities, services and advice to promote healthy living.

(2) An initiative to train teachers, staff in school libraries and staff working in public library services to use information and communications technology in order to assist learning; and to make materials of an educational nature available in a digital form on such technology.

(3) An initiative to provide activities outside school hours for children who attend school.

4.  For the purposes of article 3(3) a child shall be regarded as attending school notwithstanding that he is excluded, permanently or temporarily, from school.

Explanatory Note

(This note is not part of the Order)

The New Opportunities Fund may make grants to fund or assist in the funding of projects or make or enter into arrangements which are designed to give effect to initiatives concerned or connected with health, education and the environment specified to it by the Secretary of State. This Order specifies three such initiatives which apply throughout the United Kingdom. The specified initiatives are initiatives:—

(i)to provide facilities, services and advice to promote healthy living;

(ii)to train teachers, staff working in school libraries and staff working in public library services to use information and communications technology to assist learning; and to make materials of an educational nature available in a digital form on such technology; and

(iii)to provide activities outside school hours for children who attend school.

1993 c. 39. Section 43B was inserted by section 7(2) of the National Lottery Act 1998 (c. 22).

Section 43C(4) of the National Lottery etc. Act 1993 (“the 1993 Act”) inserted by section 7(2) of the National Lottery Act 1998 (“the 1998 Act”) provides that before making an order under section 43B in respect of a particular initiative, the Secretary of State shall consult such persons as appear to him appropriate. Section 8(5) of the 1998 Act provides that consultation undertaken before the commencement of section 7 of that Act in connection with the specification of an initiative shall be as effective in relation to that initiative as if section 7 had been in force at the time the consultation was undertaken. Section 8(6) of the 1998 Act further provides that where any consultation has been undertaken before the commencement of section 7 of that Act in connection with one or more initiatives proposed to be specified in an order made under section 43B of the 1993 Act which specifies only that or those initiatives, that order shall, notwithstanding the provisions of section 60(2) of that Act (as amended by section 15(2) of the 1998 Act), be subject to annulment in pursuance of a resolution of either House of Parliament.
