Explanatory Note

(This note is not part of the Regulations)

These Regulations make transitional provision in consequence of the commencement of section 13 of the School Standards and Framework Act 1998. Section 13 substitutes a new section 3 of the School Teachers' Pay and Conditions Act 1991. The regulations modify paragraph 7 of Schedule 32 to the 1998 Act, which makes transitional provision arising from the amendment made by section 13. The effect of the transitional provision in these Regulations is as follows:–

(a)in relation to an order already made under section 3 before 1st September 1998, paragraph 7 of Schedule 32 is modified so that, for the period ending immediately before the appointed day (1st September 1999), it applies to any orders already so made (regulation 2);

(b)further orders may be made under section 3, as in force before the amendment made by section 13 of the 1998 Act, if an application is made to the Secretary of State by 31st March 1999 (regulation 3), and paragraph 7 of Schedule 32 is modified so as to apply to such orders (regulation 4).

(3)

The “appointed day” is defined in section 20(7) of the School Standards and Framework Act 1998. S.I. 1998/2083 prescribes the appointed day as 1st September 1999.
