The Teaching and Higher Education Act 1998 (Commencement No. 3) Order 1998

In exercise of the powers conferred by section 46(4) of the Teaching and Higher Education Act 1998(1), the Secretary of State for Education and Employment hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Teaching and Higher Education Act 1998 (Commencement No. 3) Order 1998.

(2) In this Order–

“the 1988 Act” means the Education Reform Act 1988(2); and

“the 1998 Act” means the Teaching and Higher Education Act 1998.

Provisions coming into force

2.  The following provisions of the 1998 Act shall come into force on 1st October 1998:

  • section 1(1), to the extent that it defines the “the Council” but not so as to establish the General Teaching Council for England as a body;

  • section 1(2) to (10);

  • section 8;

  • section 16;

  • section 17;

  • section 19(1) to (8) and 10(b) and (c);

  • section 20;

  • section 21;

  • section 34;

  • section 35;

  • section 40;

  • section 41;

  • section 44(1), to the extent that it relates to the provisions of Schedule 3 specified below;

  • section 44(2), to the extent that it relates to the provisions of Schedule 4 specified below;

  • Schedule 1;

  • in Schedule 3–

    • paragraph 5;

    • paragraph 6;

    • paragraph 7;

    • paragraph 8;

    • paragraph 9; and

    • paragraph 15;

  • in Schedule 4, the repeal of–

  • in section 218(1)(c) of the 1988 Act, the words “schools and”; and

  • in section 232(6) of the 1988 Act, the words “other than section 218(1)(b) or (c), (5) or (6)”.

3.  Section 19(9) and (10)(a) of the 1998 Act shall come into force on 1st April 1999.

Explanatory Note

(This note is not part of the Order)

This Order brings certain provisions of the Teaching and Higher Education Act 1998 into force on 1st October 1998 and 1st April 1999. The provisions are listed in articles 2 and 3 respectively of the Order.
