The School Standards and Framework Act 1998 (Commencement No. 3 and Saving and Transitional Provisions) Order 1998

In exercise of the powers conferred on the Secretary of State by sections 145(3) and 138(7) of the School Standards and Framework Act 1998(1), the Secretary of State for Education and Employment hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the School Standards and Framework Act 1998 (Commencement No. 3 and Saving and Transitional Provisions) Order 1998.

(2) In this Order—

“the 1996 Act” means the Education Act 1996(2); and

“the 1998 Act” means the School Standards and Framework Act 1998.

Commencement of paragraph 139 of Schedule 30

2.  Paragraph 139 of Schedule 30 to the 1998 Act (which amends section 519 of the 1996 Act: allowances for governors etc.) shall come into force—

(a)on 20th November 1998 for the purposes of making schemes and regulations under the said section 519; and

(b)on 1st April 1999 for all other purposes.

Commencement of paragraph 153 of Schedule 30

3.  Paragraph 153 of Schedule 30 to the 1998 Act (which substitutes a new section 537A in the 1996 Act: individual pupil information) shall come into force on 20th November 1998.

Saving and transitional provisions

4.  The amendment of section 519 of the 1996 Act by paragraph 139 of Schedule 30 to the 1998 Act shall not affect the operation of section 519 in its unamended form and schemes made thereunder in relation to the period ending immediately before 1st April 1999.

5.  Section 537A of the 1996 Act in the form in which it existed immediately before its substitution by paragraph 153 of Schedule 30 to the 1998 Act and any subordinate legislation made thereunder, shall continue to have effect until 1st April 1999 in relation to the provision of individual performance information.

Explanatory Note

(This note is not part of the Order)

This Order brings into force, on 20th November 1998, paragraphs 139 and 153 of Schedule 30 to the School Standards and Framework Act 1998. Paragraph 139 amends section 519 of the Education Act 1996 which relates to the payment of allowances to, inter alia, governors of schools which do not have delegated budgets and of institutions of further education maintained by local education authorities. Paragraph 153 substitutes a new section 537A in the Education Act 1996, which relates to the provision of information about individual pupils.
