The Secretary of State, in exercise of the powers conferred on him by section 121 of the Crime and Disorder Act 1998(1), hereby makes the following Order:
1. This Order may be cited as the Crime and Disorder Act 1998 (Commencement No. 2 and Transitional Provisions) (Amendment) (No. 2) Order 1998 and shall come into force on 30th November 1998.
2.—(1) Article 4 of the Crime and Disorder Act 1998 (Commencement No. 2 and Transitional Provisions) Order 1998(2) shall be amended in accordance with the following provisions of this article.
(2) Paragraph (1)(i) shall be omitted.
(3) After paragraph (1) there shall be inserted the following paragraph:
“(1A) Section 26 of the 1998 Act (retention and disposal of things seized) shall come into force on 1st December 1998 for the purpose of making regulations under section 60A of the Criminal Justice and Public Order Act 1994(3).”.

This Order amends the Crime and Disorder Act 1998 (Commencement No. 2 and Transitional Provisions) Order 1998 by substituting, for the provision that sections 25 to 27 of the Crime and Disorder Act 1998 shall come into force on 1st December 1998, a provision that section 26 shall come into force on that date for the purpose of making regulations under section 60A of the Criminal Justice and Public Order Act 1994 (which is inserted by that section).
1994 c. 33; section 60A was inserted by section 26 of the Crime and Disorder Act 1998.
