Whereas under section 17(1) of the Local Government (Scotland) Act 1973(1), as read with Schedule 5 to that Act(2), the Local Government Boundary Commission for Scotland on 20th August 1998 submitted to the Secretary of State a report on a review together with its proposals for the future electoral arrangements for the area of Midlothian Council;

Now, therefore, in exercise of the powers conferred on him by sections 17(2) and 233(3) of, and Schedule 5 to, the said Act and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Midlothian (Electoral Arrangements) Order 1998 and shall come into force on 1st January 1999.

Interpretation

2.  In the Schedule to this Order–

(a)a reference to–

(i)an electoral ward is a reference to that electoral ward as constituted in this Order; and

(ii)a road, footpath, railway line, river, burn or canal shall, where the context so admits, be construed as a reference to the centre line of the feature concerned; and

(b)the following abbreviations are used:–

  • “EW” for electoral ward;

  • “NG Ref” for National Grid Reference as published on Ordnance Survey Maps.

Electoral arrangements

3.  The area of Midlothian Council shall be divided into 18 wards, having the names, contents and boundaries set forth in the Schedule to this Order.

SCHEDULEELECTORAL WARDS

Ward 1 Penicuik South West

Commencing on the western boundary of Midlothian Council on the northwest side of Cock Rig Hill at National Grid (NG) Ref NT 1433 5983; then generally northeastward along the Midlothian Council boundary to the point where the footpath from Bavelaw Castle intersects the boundary at NG Ref NT 1740 6256; then along the said footpath generally southeastward along the Green Cleuch and northeastward along the north side of the Loganlee Reservoir to NG Ref NT 2049 6303 east of Logan House; then generally southeastward along the field boundaries to the point where the field boundaries intersect with the Lawhead Burn at NG Ref NT 2156 6175; then generally southeastward along the course of the said burn crossing the A702 (T) trunk road and an unnamed road to the point where the Lawhead Burn intersects with Rullion Road, Penicuik at NG Ref NT 2265 6084; then southwestward along the middle of Rullion Road to the western end of Cuiken Terrace; then along the middle of Cuiken Terrace to the eastern end where it meets the A701 road Edinburgh Road at NG Ref NT 2357 6080; then generally southwestward along the middle of Edinburgh Road to the point where it joins the A766 Carlops Road; then generally southwestward along the middle of Carlops Road to Spear Gate Lodge at NG Ref NT 2234 5995; then along the track generally southwestward to the east of Penicuik House; then southeastward along the field boundary to the point at Serpentine Wood; and in the same direction to the footbridge at the River North Esk; then generally southwestward along the course of the River North Esk to the point where it meets the Midlothian Council boundary at NG Ref NT 1895 5664; then along the said boundary following the River North Esk to Carlops; and along the said boundary northward and northwestward following the River North Esk to the North Esk Reservoir; and along the said boundary following the course of the river in the same direction to the western boundary of Midlothian Council at NG Ref NT 1433 5983.

Ward 2 Penicuik North

Commencing on the boundary of Midlothian Council at the point where the footpath from Bavelaw Castle intersects the boundary at NG Ref NT 1740 6256 then along the Midlothian Boundary northeastward and then southeastward to the point where the boundary meets the Kirk Burn; then southward along the course of the Kirk Burn to Kirk Bridge on the north side of Glencorse Reservoir; then along the road following the northeast side of the reservoir and in the same direction to Flotterstone Bridge and to the A702 (T) trunk road; then generally eastward and southeastward along the course of the Glencorse Burn to the Milton Bridge on the A701 road; then southwestward along the A701 road to the point where it meets the Midlothian Council Ward 1 boundary at NG Ref NT 2357 6080; then along the common boundary with the Midlothian Council Ward 1 boundary to NG Ref NT 1740 6256.

Ward 3 Penicuik/Roslin

Commencing at the northwest end of Eastfield Drive, Penicuik and its junction with Edinburgh Road, Penicuik northeastward along the A701 road to the junction with the B7006 road; then generally southeastward along the B7006 road to Main Street, Roslin and continuing along Chapel Loan to Roslin Chapel and south of Slatebarns; then along the field boundary generally eastward and southward to the River North Esk; then southwestward along the course of the river to an unnamed burn at NG Ref NT 2756 6284; then along the course of the burn southeastward and southward, crossing the B7003 road and southwestward to the point where it meets the dismantled railway at NG Ref NT 2768 6239; then southwestward along the dismantled railway to NG Ref NT 2611 6172; then northwestward along the course of an unnamed burn to the River North Esk; then generally westward and southward along the course of the River North Esk to the B7026 road at Wester Auchendinny Bridge; then generally southward along the B7026 road to Maybank at the junction with Harpers Brae; then generally southwestward along Harpers Brae to Esk Bridge; then southwestward along Eskmill Road to and northwestward along Eastfield Drive to the commencement point at the northwest end of Eastfield Drive, Penicuik and its junction with Edinburgh Road, Penicuik.

Ward 4 Penicuik South East

Ward 6 Loanhead

Commencing on the Midlothian Council boundary on the common point with the Midlothian Council Ward 5 boundary at the A720 Edinburgh City Bypass where it intersects with the A701 Straiton Intersection; then eastward along the Midlothian Council boundary to the junction of the Edinburgh City Bypass and the A768 road Lasswade Road; then southeast and southward along Lasswade Road to the point where it meets Haveral Wood; then generally westward and southeastward along the northern and eastern boundaries of Haveral Wood and continuing southeastward across the Haveral Wood Sand Quarry to Wadingburn Road; then eastward along Wadingburn Road to the point where it meets the western boundary of the properties on the west side of Kevock Road; then generally southward along the western boundaries of the said properties and southwestward along an unnamed road to Glenkevock and continuing in the same direction to the River North Esk; then southwestward along the course of the River North Esk to the point where it meets the Bilston Burn at the southern end of Polton Road; then along the common boundary with the Midlothian Council Ward 5 boundary to the common point on the Midlothian Council boundary at the A720 Edinburgh City Bypass where it intersects with the A701 Straiton Intersection.

Ward 7 Poltonhall/Rosewell

Commencing on the common point with the Midlothian Council Wards 3 and 4 boundaries on the River North Esk where it meets an unnamed burn at NG Ref NT 2578 6146; then northeastward along the common ward boundaries of the Midlothian Council Wards 3, 5 and 6 to the common point with the Midlothian Council Ward 6 boundary on the River North Esk south west of Glenkevock at NG Ref NT 2935 6536; then eastward along the course of the River North Esk to a drain to the east of the riding centre at NG Ref NT 3002 6549; then generally southward along the drain to the entrance to Polton House printing works on Polton Road and continuing along Polton Road in the same direction to where it meets the northern end of Eskdale Drive; then southeastward along Eskdale Drive and southwestward to Hopefield Park; then northwestward along Hopefield Park and Dalhousie Avenue to the point where it meets Dalhousie Drive; then generally southwestward along Dalhousie Drive, Polton Avenue Road, the southern boundary of the school playground and northern boundary of the playing field; then southeastward along the western boundary of the playing field to Rosewell Road; then southwestward along Rosewell Road to an unclassified road on the northern boundary of Rosewell Manse; then generally southeastward along the unclassified road to Parkneuk, Shiel Bridge, Capielaw and the crossroads at NG Ref NT 3057 6132; then southwestward along the unclassified road to the point where it meets the southern boundary of Cowies Bank Strip wood; then along the southern boundary of the said wood to the point where it meets the eastern boundary of Edgelaw Moor Strip wood; then southwestward along the eastern boundary of Edgelaw Moor Strip to the point where it meets the Midlothian Council Ward 4 boundary; then generally northwestward along the common ward boundary with the Midlothian Council Ward 4 to the common point with the Midlothian Council Wards 3 and 4 boundaries.

Commencing on the common point on the ward boundaries of Midlothian Council Wards 6 and 7 at NG Ref NT 2935 6536; then generally northward along the common ward boundary with Midlothian Council Ward 6 boundary to the point where Haveral Wood meets Lasswade Road; then continuing generally south and eastward along Lasswade Road to the western boundary of the properties at the east end of Lasswade Road; then north and eastward along the boundaries of the said properties to the River North Esk; then along the course of the River North Esk to the field boundary with the wood at the west end of the Melville Castle Hotel properties at NG Ref NT 3058 6639; then generally southward along the said boundary to the junction of Elm Row, the B704 and Melville Dykes Road; then generally east along Melville Dykes Road to the junction with the track at the northern end of Viewbank Avenue; then southeastward along the said track and Viewbank Avenue to it’s southern end where it meets Eskbank Road; then generally southwestward along Eskbank Road, Lothian Street and Polton Street to the junction with Dobbies Road; then northwestward along Dobbies Road to the junction with Hawthornden Avenue; then southwestward along Hawthornden Avenue to where it meets the Midlothian Council Ward 7 boundary; then generally northwestward along the common ward boundary to the common point on the ward boundaries of Midlothian Council Wards 6 and 7 at NG Ref NT 2935 6536.

Explanatory Note

(This note is not part of the Order)

This Order gives effect to proposals made by the Local Government Boundary Commission for Scotland for the future electoral arrangements for the area of Midlothian Council. The proposals follow on the review of the whole of Scotland undertaken by the Commission in terms of Schedule 5 to the Local Government (Scotland) Act 1973. The area of Midlothian Council is divided into 18 electoral wards as described in the Schedule to the Order. The Order makes minor modifications to the boundaries of Wards 4, 12, 15 and 16 as compared to the proposals submitted to the Secretary of State by the Commission. In terms of paragraph 1 of Schedule 2 to the Local Government etc. (Scotland) Act 1994, the wards apply with effect from the ordinary election of councillors due to take place in May 1999.
