The Secretary of State for Health, in exercise of powers conferred on him by sections 16(2) and 126(4) of, and paragraphs 10, 12 and 16 of Schedule 5 to, the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

1977 c. 49. Section 16 was substituted by section 7 of the Health Authorities Act 1995 (c. 17); section 126(4) was amended by section 65(2) of the National Health Service and Community Care Act 1990 (c. 19) (“the 1990 Act”); paragraph 12 of Schedule 5 was amended by article 7 of S.I. 1985/39, by paragraph 9 of Schedule 1 to the 1990 Act and by paragraph 60(e) of Schedule 1 to the Health Authorities Act 1995 (c. 17). See section 128(1), as amended by section 26(2)(g) and (i) of the 1990 Act, for the definitions of “prescribed” and “regulations”.
