The Secretary of State, being designated for the purposes of, and in exercise of the powers conferred by, section 2(2) of the European Communities Act 1972M1 and in exercise of all other powers enabling him in that behalf, hereby makes the following Regulations:—

1. These Regulations may be cited as the European Specialist Medical Qualifications Amendment (No. 2) Regulations 1999 and shall come into force on 17th December 1999.
2.—(1) The European Specialist Medical Qualifications Order 1995 M2 shall be amended in accordance with the following provisions of this regulation.
(2) In article 2(1)(b) (interpretation) M3, at the end, insert “, and by Commission Directive 99/46/EC of 21st May 1999 M4".
(3) In Schedule 2 (which lists medical specialties in which qualifications are awarded in the United Kingdom), in Part I—
(a)for “Clinical radiology"M5 substitute “Clinical radiology*"; and
(b)for “Clinical oncology"M6 substitute “Clinical oncology*".

These Regulations amend the European Specialist Medical Qualifications Order 1995 (“the 1995 Order"), which implemented European obligations contained principally in Council Directive 93/16/EEC (OJ No. L165, 7.7.93, p. 1) relating to the training of specialist doctors and mutual recognition of their qualifications (“the Directive"). The need for changes to the 1995 Order arises from amendments to the Directive made by Commission Directive 99/46/EC (OJ No. L139, 2.6.99, p. 25).
Schedule 2 to the 1995 Order is amended so as to indicate that clinical radiology (formerly known as diagnostic radiology, and as radiology) and clinical oncology (formerly known as radiotherapy) are now medical specialties common to all EEA states.
