The Secretary of State for Trade and Industry, with the consent of the Treasury, in exercise of the powers conferred on him by section 56(1) and (2) of the Finance Act 1973(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Measuring Instruments (EEC Requirements) (Fees) (Amendment) Regulations 1999 and shall come into force on 1st May 1999.
2. The Measuring Instruments (EEC Requirements) (Fees) Regulations 1998(2) are hereby amended as follows–
(a)in regulation 2(1), in the definition of the “1988 principal Regulations”, for “1998” there shall be substituted “1988”;
(b)in regulation 5, for “designation of approved bodies” there shall be substituted “designation or inspection of approved bodies”;
(c)in paragraph 2 of Schedule 2, for “paragraphs 3 and 4” there shall be substituted “paragraph 4”; and
(d)after paragraph 2 of Schedule 4, there shall be inserted the following paragraph–
“2A. Where regulation 9(4) of the 1995 principal Regulations applies (variation or amendment, on request, of an approval) the fees shall be calculated on the same basis, and shall be due and payable in the same manner, as those relating to designation under paragraph 1 above except that, for the fixed fee of £260.00 for which paragraph 1(a) provides, there shall be substituted a fixed fee of £130.00.”.

These Regulations amend the Measuring Instruments (EEC Requirements) (Fees) Regulations 1998 (S.I. 1998/1177) (the principal Regulations) to provide for the payment and calculation of fees in respect of services provided by the Department of Trade and Industry in relation to the variation or amendment, on request, of an approval of a body for the purposes of regulation 9(4) of the Non-automatic Weighing Instruments (EEC Requirements) Regulations 1995 (S.I. 1995/1907) (regulation 2(d) introducing paragraph 2A of Schedule 4 to the principal Regulations). The provision restores payment for these services provided by the Department and increases the fixed fee to £130.00 (an increase of £30.00) from that previously payable (until 1st June 1998, when the principal Regulations came into force) in respect of such services under the Measuring Instruments (EEC Requirements) (Fees) Regulations 1993 (S.I. 1993/798, as amended by S.I. 1995/1376).
Also these Regulations make some minor amendments to the principal Regulations to correct typographical errors in its regulations 2(1) and 5 and in paragraph 2 of its Schedule 2 (regulations 2(a), (b) and (c)).
