Explanatory Note

(This note is not part of the Order)

This Order continues in force the temporary provisions of the Northern Ireland (Emergency Provisions) Act 1996 (which for these purposes include section 4 of the Criminal Justice (Terrorism and Conspiracy) Act 1998 so far as it applies to Northern Ireland) for a period beginning with 16th June 2000 and ending with 24th August 2000, when the 1996 Act would repeal itself.

This Order also continues in force for the same period the provisions referred to in section 27(11) of the Prevention of Terrorism (Temporary Provisions) Act 1989.

The 1996 and 1989 Acts will be repealed and replaced by the Terrorism Bill which is currently before Parliament.

(1)

1996 c. 22; the automatic repeal of the 1996 Act was postponed by the Northern Ireland (Emergency Provisions) Act 1998 (c. 9), which also amended the 1996 Act. Sections 30A and 30B of the 1996 Act were inserted by section 2 of the Criminal Justice (Terrorism and Conspiracy) Act 1998.

(2)

1989 c. 4; subsection (11) was substituted by section 63(6) of, and paragraph 7(3) of Schedule 6 to, the 1996 Act, and was amended by paragraph 1 of Schedule 1 to the Northern Ireland (Emergency Provisions) Act 1998.
