The Access to Justice Act 1999 (Bar Practising Certificates) Order 2001

Whereas the Lord Chancellor pursuant to section 46(4)(a) of the Access to Justice Act 1999(1) has consulted the General Council of the Bar;

And whereas a draft of this Order has been laid before, and approved by a resolution of, each House of Parliament pursuant to section 46(4)(b) of that Act;

Now, therefore, the Lord Chancellor, in exercise of the powers conferred upon him by section 46(3)(a) of that Act, hereby makes the following Order:

1.  This Order may be cited as the Access to Justice Act 1999 (Bar Practising Certificates) Order 2001 and shall come into force on 31st January 2001.

2.  In section 46(2)(b) of the Access to Justice Act 1999, after “purposes of” insert “(i)” and at the end insert—

(ii)the participation by the Council in law reform and the legislative process,

(iii)the provision by barristers and those wishing to become barristers of free legal services to the public,

(iv)the promotion of the protection by law of human rights and fundamental freedoms, and

(v)the promotion of relations between the Council and bodies representing the members of legal professions in jurisdictions other than England and Wales..

Explanatory Note

(This note is not part of the Order)

This Order amends section 46(2)(b) of the Access to Justice Act 1999 by adding to the existing purposes referred to in that section for which the General Council of the Bar may raise fees by the issuing of practising certificates.
