Whereas a draft of this Order has been laid before and approved by resolution of each House of Parliament, pursuant to paragraph 4 of Part I of Schedule 2 to the Broadcasting Act 1990(1);
Now, therefore, the Secretary of State, in exercise of the powers conferred on him by paragraph 5(5)(a) of Part III of Schedule 2 to the Broadcasting Act 1990, hereby makes the following Order:
1. This Order may be cited as the Broadcasting (Limit on the Holding of Licences to Provide Television Multiplex Services) Order 2001 and shall come into force on the day after the day on which it is made.
2. Paragraph 5 of Part III of Schedule 2 to the Broadcasting Act 1990 shall be amended as follows—
(a)in sub-paragraph (1), for the word “three” shall be substituted the word “six”;
(b)in sub-paragraph (3), for the word “five” shall be substituted the word “eight”;
(c)in sub-paragraph (4)(a), for the word “three” shall be substituted the word “six” and for the word “two” shall be substituted the word “five”; and
(d)in sub-paragraph (4)(b), for the word “five” shall be substituted the word “eight” and for the word “four” shall be substituted the word “seven”.

This Order changes the limit on the number of licences to provide television multiplex services which a person may at any time hold, from three to six, and makes consequential changes to other limits placed on the holding of those licences.
1990 c. 42. Paragraph 4 of Part I of Schedule 2 was amended by paragraph 5 of Part I of Schedule 2 to the Broadcasting Act 1996 (c. 55). Part III of Schedule 2 was substituted by paragraph 10 of Part III of Schedule 2 to the Broadcasting Act 1996.
