The Secretary of State for Work and Pensions, in exercise of the powers conferred upon him by section 122(1) and (6) of the Housing Act 1996(1) and of all other powers enabling him in that behalf, hereby makes the following Order:
1.—(1) This Order may be cited as the Rent Officers (Housing Benefit Functions) (Amendment) (No.2) Order 2001 and shall come into force on 2nd July 2001.
(2) This Order extends to England and Wales only.
2.—(1) The Rent Officers (Housing Benefit Functions) Order 1997(2) shall be amended in accordance with this article.
(2) In article 3A, the words “the day before” shall be omitted.
(3) In paragraph 4(2)(b)(iii) of Schedule 1 to that Order, for the words “kitchen or toilet”, in both places where those words occur, there shall be substituted the words “kitchen, toilet, bathroom and room suitable for living in”.

Article 2 of this Order amends the Rent Officers (Housing Benefit Functions) Order 1997 which confers functions on rent officers, in connection with housing benefit and rent allowance subsidy, and requires them to make determinations and redeterminations in respect of tenancies and licences of dwellings. In particular it makes an amendment to the local reference rent provisions in Schedule 1 to that Order. It also amends the date on which rent officer determinations made before 2nd July 2001 shall cease to have effect.
This Order does not impose any costs on business.
