The Secretary of State, in exercise of the powers conferred by sections 23A(3), 23B(5), (6), (8)(c), (10), 23D(2), 23E, 24B(6), 24D(2) and 104(4) of, and paragraphs 19B(2), (3), (7) and (8) of Schedule 2 to, the Children Act 1989(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1989 c. 41. Sections 23A and 23B are inserted by the Children (Leaving Care) Act 2000 (c. 35) (“the 2000 Act”), section 2(4); sections 23D and 23E are inserted by section 3 of the 2000 Act; sections 24B and 24D are inserted by section 4 of the 2000 Act, which substitutes section 24 of the 1989 Act. Paragraph 19B of Schedule 2 is inserted by section 1 of the 2000 Act. The functions of the Secretary of State under these provisions in respect of Wales are transferred to the National Assembly for Wales by article 2 of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), and section 8(7) of the 2000 Act. See section 105(1) of the Act for the definition of “prescribed”.
