Whereas, pursuant to section 18(1) of the Agriculture Act 1986(1), the Minister of Agriculture, Fisheries and Food (“the Minister”) has designated areas in Breckland, Clun, North Peak, the Suffolk River Valleys and the Test Valley as environmentally sensitive areas;
Now, therefore, the Minister, in exercise of the powers conferred on her by section 18(1) and (4)(d)(2) of the said Act, and of all other powers enabling her in that behalf, with the consent of the Treasury, hereby makes the following Order:
1. This Order may be cited as the Environmentally Sensitive Areas (Stage II) Designation (Amendment) Order 2001 and shall come into force on 15th October 2001.

2. In this Order “the principal Order” means the Environmentally Sensitive Areas (Stage II) Designation Order 2000(3).

3.—(1) Part 3 of Schedule 1 to the principal Order shall be amended, in column 2, by the substitution—
(a)in item 1, of “135” for the figure “125”;
(b)in item 2(a), of “375” for the figure “350”;
(c)in item 2(d)(i), of “300” for the figure “280”; and
(d)in item 3(b), of “70” for the figure “50”.
(2) Part 3 of Schedule 2 to the principal Order shall be amended, in column 2, by the substitution—
(a)in item 1(a), of “35” for the figure “34”;
(b)in item 2(a), of “110” for the figure “100”;
(c)in item 2(b), of “190” for the figure “180”;
(d)in item 3, of “150” for the figure “120”;

(3) For Part 3 of Schedule 3 to the principal Order there shall be substituted Part 3 as set out in the Schedule to this Order.

(a)in item 2, of “290” for the figure “270”;
(b)in item 4, of “340” for the figure “290”;
(c)in item 5, of “80” for the figure “50”;
(d)in item 6, of “60” for the figure “50”; and
(e)in item 8, of “170” for the figure “130”.
(5) Part 3 of Schedule 5 to the principal Order shall be amended, in column 2, by the substitution—
(a)in item 1, of “35” for the figure “25”;
(b)in item 2, of “135” for the figure “110”;
(c)in item 3, of “50” for the figure “45”;
(d)in item 4, of “40” for the figure “35”;

This Order amends the Environmentally Sensitive Areas (Stage II) Order 2000 (“the principal Order” which designated areas in Breckland, Clun, the North Peak, the Suffolk River Valleys and the Test Valley as environmentally sensitive areas.
The Order amends, with effect from 15th October 2001, some of the rates of payments to be made by the Minister of Agriculture, Fisheries and Food, pursuant to a management agreement made under section 18(3) of the Agriculture Act 1986 (article 3).
