The Secretary of State, in exercise of the powers conferred by sections 33 and 60 of the Electricity Act 1989(1), hereby makes the following Regulations:—
1989 c. 29; section 66 of the Utilities Act 2000 (c. 27) provided that section 33 of the Electricity Act 1989 was to cease to have effect. However pursuant to section 67 of the Utilities Act 2000, article 11 of the Non-Fossil Fuel Sources Saving Arrangements Order 2000 (S.I. 2000/2727) (as amended by S.I. 2001/3268) provided that section 33 of the Electricity Act 1989 would continue to have effect with certain modifications.
