The Community Charges, Council Tax and Non-Domestic Rating (Enforcement) (Magistrates' Courts) (England) Regulations 2001

The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred upon him by section 143(2) of, and paragraphs 1 and 8 of Schedule 4 and paragraphs 1 and 3 of Schedule 9 to, the Local Government Finance Act 1988() and section 113(2) of, and paragraphs 1 and 8 of Schedule 4 to, the Local Government Finance Act 1992() hereby makes the following Regulations:
Citation, commencement and extent
1. These Regulations, which extend to England only, may be cited as the Community Charges, Council Tax and Non-Domestic Rating (Enforcement) (Magistrates' Courts) (England) Regulations 2001 and shall come into force on 1st April 2001.
Amendment of regulations
2. In each of the following provisions, for the words “clerk of the court ” there shall be substituted the words “justices' chief executive for the court”—
(a)regulation 52(4) of the Community Charges (Administration and Enforcement) Regulations 1989();
(b)regulation 23(4) of the Non-Domestic Rating (Collection and Enforcement) (Local Lists) Regulations 1989();
(c)regulation 57(3) of the Council Tax (Administration and Enforcement) Regulations 1992().

Explanatory Note
These Regulations, which extend to England only, amend the following instruments to transfer the administrative functions of justices' clerks under them to justices' chief executives:
the Community Charges (Administration and Enforcement) Regulations 1989;
the Non-Domestic Rating (Collection and Enforcement) (Local Lists) Regulations 1989;
the Council Tax (Administration and Enforcement) Regulations 1992.
Similar transfers are made by section 90 of and Schedule 13 to the Access to Justice Act 1999 (c. 22).
