Whereas a draft of this Order has been laid before Parliament on the recommendation of the Advisory Council on the Misuse of Drugs and has been approved by a resolution of each House of Parliament:
Now, therefore, Her Majesty, in pursuance of section 2(2) of the Misuse of Drugs Act 1971(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:
1. This Order may be cited as the Misuse of Drugs Act 1971 (Modification) Order 2001 and shall come into force on 1st February 2002.
2.—(1) Schedule 2 to the Misuse of Drugs Act 1971(2) (which specifies the drugs which are subject to control under that Act) shall be amended as follows.
(2) After sub-paragraph (b) of paragraph 1 of Part I of that Schedule there shall be inserted the following sub-paragraph—
“(ba)the following phenethylamine derivatives, namely:—
Allyl(α-methyl-3,4-methylenedioxyphenethyl)amine
2-Amino-1-(2,5-dimethoxy-4-methylphenyl)ethanol
2-Amino-1-(3,4-dimethoxyphenyl)ethanol
Benzyl(α-methyl-3,4-methylenedioxyphenethyl)amine
4-Bromo-β,2,5-trimethoxyphenethylamine
N-(4-sec-Butylthio-2,5-dimethoxyphenethyl)hydroxylamine
Cyclopropylmethyl(α-methyl-3,4-methylenedioxyphenethyl)amine
2-(4,7-Dimethoxy-2,3-dihydro-1H-indan-5-yl)ethylamine
2-(4,7-Dimethoxy-2,3-dihydro-1H-indan-5-yl)-1-methylethylamine
2-(2,5-Dimethoxy-4-methylphenyl)cyclopropylamine
2-(1,4-Dimethoxy-2-naphthyl)ethylamine
2-(1,4-Dimethoxy-2-naphthyl)-1-methylethylamine
N-(2,5-Dimethoxy-4-propylthiophenethyl)hydroxylamine
2-(1,4-Dimethoxy-5,6,7,8-tetrahydro-2-naphthyl)ethylamine
2-(1,4-Dimethoxy-5,6,7,8-tetrahydro-2-naphthyl)-1-methylethylamine
α,α-Dimethyl-3,4-methylenedioxyphenethylamine
α,α-Dimethyl-3,4-methylenedioxyphenethyl(methyl)amine
Dimethyl(α-methyl-3,4-methylenedioxyphenethyl)amine
N-(4-Ethylthio-2,5-dimethoxyphenethyl)hydroxylamine
4-Iodo-2,5-dimethoxy-α-methylphenethyl(dimethyl)amine

O-Methyl-N-(α-methyl-3,4-methylenedioxyphenethyl)hydroxylamine
α-Methyl-4-(methylthio)phenethylamine

β,2,5-Trimethoxy-4-methylphenethylamine;”.
(3) In paragraph 1(a) of Part II of that Schedule after the word “Methylamphetamine” there shall be inserted the word “α-Methylphenethylhydroxylamine;”.

This Order adds thirty-six substances to Schedule 2 to the Misuse of Drugs Act 1971 which specifies drugs which are subject to control under the Act. The thirty-six substances are phenethylamine derivatives which are not covered by the definition in paragraph 1(c) of Part I of Schedule 2 to the 1971 Act. Thirty-five of the substances are added as Class A drugs; and α-Methylphenethylhydroxylamine is added as a Class B drug.
