Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Motor Vehicles (Driving Licences) Regulations 1999 (“the principal Regulations”) as follows.

Regulations 3 and 5 amend, respectively, regulations 3 and 40 of the principal regulations by replacing the theory test currently taken by those wishing to obtain a driving licence with a two-part theory test. Part I of the new two-part theory test consists of the old theory test, consisting of a test of driving theory. Part II consists of a test of the candidate’s ability to recognise hazards to driving (“a hazard perception test”).

Regulation 4 increases the amount that may be charged by the Secretary of State to those applying to take the theory test from £15.50 to £18. (This amounts to an increase of approximately 16%; this is the first increase in the charge since the principal Regulations were made in 1999).

Regulation 6 increases the amount that the Secretary of State may charge examiners not employed by the Driving Standards Agency for the supply of theory test pass certificates from £5 to £7.50. (This amounts to an increase of 50%; this is the first increase in the charge since the principal Regulations were made in 1999).

Regulation 7 increases the amount that the Secretary of State may charge examiners appointed by the Secretary of State for Defence for the supply of practical or unitary test pass certificates from £2.43 to £2.75. (This amounts to an increase of 13%; this is the first increase in the charge since the principal Regulations were made in 1999).

Regulation 8 and the Schedule amend the fees payable upon an application for a practical or a unitary driving test where the application is made on or after the coming into force of these Regulations. The following tables show the new fees with the percentage increase in brackets.
