In exercise of the powers conferred by sections 152(6) and 154(1) and (3) of the Learning and Skills Act 2000(1), the Secretary of State for Education and Skills hereby makes the following Order:
1.—(1) This Order may be cited as the Learning and Skills Act 2000 (Commencement No. 4) and Transitional Provisions Order 2002.
(2) In this Order “the Act” means the Learning and Skills Act 2000.
2.—(1) Section 7 of the Act shall come into force on 1st March 2002.
(2) The following provisions of the Act shall come into force on 1st April 2002—
(a)section 103(2) and (3) insofar as it relates to England and to the extent that it is not already in force;
(b)section 140(1) and (2) insofar as it relates to England.
(3) The following provisions of the Act shall come into force on 1st August 2002—
(a)section 97 insofar as it relates to England;
(b)section 110(2), (4) and (5) insofar as it relates to England and to the extent that it is not already in force.
3.—(1) Despite the provisions of article 2(2) above, the duty contained in section 140(2) of the Act shall not apply in relation to any person if a Connexions partnership has not been established for the area of the local education authority in which the person undertakes his last year of compulsory schooling.
(2) For the purposes of paragraph (1)—
(a)a “Connexions partnership” means a body known by that name whose functions include the provision of services such as are described in section 114 of the Act pursuant to arrangements made by the Secretary of State; and
(b)a Connexions partnership is “established” on the first occasion on which financial assistance is given to the body pursuant to section 114(3) of the Act.

This Order brings into force certain provisions of the Learning and Skills Act 2000 on 1st March, 1st April and 1st August 2002. Among the provisions brought into force is section 7, which is brought into force on 1st March 2002, and which enables the Learning and Skills Council for England to make grants to local education authorities to fund school sixth forms.
The effect of this Order is to bring into force all the remaining provisions of the Act which are not already in force.
Article 3 contains transitional provisions relating to the coming into force of section 140(2) of the Act.
