In exercise of the powers conferred upon the Secretary of State by sections 218(1)(a) and (2) and 232(5) of the Education Reform Act 1988(1) and having consulted the General Teaching Council for England in accordance with section 218(2AA) of that Act, the Secretary of State for Education and Skills hereby makes the following Regulations:
1. These Regulations may be cited as the Education (Teachers’ Qualifications and Health Standards) (England) (Amendment) Regulations 2003 and shall come into force on 21th February 2003.
2. The Education (Teachers’ Qualifications and Health Standards) (England) Regulations 1999(2) shall be amended as follows.
3. At the end of paragraph 6 of Schedule 3 after “1993” there shall be inserted “, and as amended by the Agreement between the European Community and its Member States, of the one part, and the Swiss Confederation, of the other, on the Free Movement of Persons signed at Luxembourg on 21th June 1999(3)”.

These Regulations amend the Education (Teachers’ Qualifications and Health Standards) Regulations 1999. Paragraph 6 of Schedule 3 to those Regulations is amended to treat Swiss Nationals on the same basis as EEA nationals. This gives effect to the Agreement between the European Community and its member states, of the one part, and the Swiss Confederation, of the other, on the Free Movement of Persons, signed at Luxembourg on 21th June 1999 and which came into force on 1th June 2002.
1988 c. 40. By virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) the powers conferred by section 218 are exercisable by the Secretary of State only in relation to England.
