3. There shall be excepted from section 207(2) of the Act any agreement—
(a)under which an outside contractor is to provide, or secure the provision of, reserved services in respect of any public service for the carriage of passengers by railway which is under the control of London Underground Limited; and
(b)to which London Underground Limited was a party immediately before the date on which this Order is made.
