The Secretary of State, in exercise of the powers conferred on him by section 50 of the Police Act 1996(1) and section 79A of the Police Act 1997(2), and after taking into consideration the recommendations of the Police Negotiating Board for the United Kingdom and supplying that Board with a draft of these Regulations in accordance with section 62(1) of the Police Act 1996(3), and after supplying a draft of these Regulations to the Police Advisory Board for England and Wales and taking into consideration their representations in accordance with section 63(3) of the Police Act 1996(4), hereby makes the following Regulations:
1.—(1) These Regulations may be cited as the Police (Amendment) Regulations 2003 and shall come into force on 15th November 2003.
(2) In these Regulations “the 2003 Regulations” means the Police Regulations 2003(5).
2.—(1) Regulation 3 of the 2003 Regulations shall be amended as follows.
(2) In paragraph (1)—
(a)in the definition “Conduct Regulations” after the words “section 50 of the Act” there shall be added “or section 81 of the Police Act 1997”; and
(b)in the definition “Promotion Regulations” after the words “section 50 of the Act” there shall be added “or section 79A of the Police Act 1997”.
(3) In paragraph (2) for “Police Service of Northern Ireland” on the first occasion it occurs there shall be substituted “National Crime Squad, the Police Service of Northern Ireland”.
(4) The following paragraphs are inserted—
“(2A) In these Regulations a reference to a police authority shall include a reference to the Service Authority for the National Crime Squad.
(2B) In these Regulations a reference to a chief officer shall include a reference to the Director General of the National Crime Squad.
(2C) In their application to the National Crime Squad, these Regulations shall have effect as if regulations 11 to 13, 21 and 39 were omitted.”
3.—(1) Regulation 4 of the 2003 Regulations shall be amended as follows.
(2) In paragraph (1) for “(2) and (3)” there shall be substituted “(2), (3) or (4)”.
(3) The following paragraph is inserted—
“(4) In its application to the National Crime Squad, paragraph (1) shall have effect as if the reference to Deputy Chief Constable was omitted.”
4.—(1) Regulation 5 of the 2003 Regulations shall be amended as follows.
(2) In paragraph (1) before “A chief officer” there shall be inserted “Subject to paragraph (8),”
(3) The following paragraph is inserted—
“(8) In its application to the National Crime Squad—
(a)paragraph (1) shall have effect as if the reference to “a chief officer” was omitted and a reference to “the Service Authority for the National Crime Squad” inserted; and
(b)paragraph (7) shall have effect as if sub-paragraph (a) was omitted.”
5.—(1) Regulation 8 of the 2003 Regulations is amended as follows.
(2) The following paragraph is inserted—
“(6) In its application to the National Crime Squad, this regulation shall have effect as if the reference to the “area of a police force” was omitted and a reference to “England and Wales” inserted.”
6.—(1) Regulation 21 of the 2003 Regulations shall be amended as follows.
(2) In paragraph (1) before “present force by reason only of one or more such statutory transfers” there shall be inserted “former force and became a member of his”.

These Regulations amend the Police Regulations 2003 in consequence of the bringing into force of provisions in the Police Reform Act 2002 (c. 30) which enable the National Crime Squad to recruit officers below the rank of Assistant Chief Constable for permanent positions.
Regulation 21 is also amended to correct a typographical error.
1997 c. 50; section 79A was inserted by section 89 of the Police Reform Act 2002 (c. 30).
Section 62(1) was amended by sections 90(3) and 91(3) of the Police Reform Act 2002 (c. 30): there are other amendments to section 62(1) which are not relevant to the subject matter of these Regulations.
Section 63(3) was amended by section 134(1) of, and paragraphs 72 and 83(1) and (3) of Schedule 9 to, the Police Act 1997 and by sections 90(5), 91(5) and 134(1) of, and paragraph 17 of Schedule 7 to, the Police Reform Act 2002 (c. 30).
