The Secretary of State for Transport, in exercise of the powers conferred by section 37(1) and (2) of the Private Hire Vehicles (London) Act 1998(1) and of all other powers enabling him in that behalf, and after consultation with Transport for London in accordance with section 37(3) of that Act, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Private Hire Vehicles (London) (Transitional and Saving Provisions) (Amendment) Regulations 2003 and shall come into force on 18th December 2003.

Preliminary

2.  The Private Hire Vehicles (London) (Transitional and Saving Provisions) Regulations 2003(2) shall be amended in accordance with the following provisions of these Regulations.

Issue of temporary permits

3.  The following paragraph shall be substituted for paragraph (1) of regulation 5—

(1) Transport for London may issue a temporary permit to—

(a)any existing driver; or

(b)an applicant for a London PHV driver’s licence who, at any time before 1st April 2006, has submitted an application which—

(i)meets all requirements of Transport for London made pursuant to section 15(1), (2) and (4) of the 1998 Act; and

(ii)for which any prescribed fee (or instalment) due in accordance with regulations made by Transport for London under section 20 has been paid.

Duration of temporary permits

4.  In regulation 6(1) after sub-paragraph (b) there shall be inserted the following sub-paragraph—

(bb)in the case of a temporary permit issued pursuant to regulation 5(1)(b), on the last day of the period of 3 months beginning with the day on which the temporary permit is issued or such later date (if any) as Transport for London may from time to time notify to the holder;.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Private Hire Vehicles (London) (Transitional and Saving Provisions) Regulations 2003 (“the Principal Regulations”).

Regulation 3 amends regulation 5 of the Principal Regulations so as to enable Transport for London to issue a temporary permit to any person who, before 1st April 2006, duly applies for a London PHV driver’s licence and pays the application fee.

Regulation 4 amends regulation 6 of the Principal Regulations so as to provide that a temporary permit issued under this new power, unless it otherwise ceases to have effect under that regulation, is to last for a period of 3 months beginning with the day of issue or such later date as Transport for London may from time to time notify to the holder.

A full regulatory impact assessment has not been produced for this instrument because it has no impact on the costs of business.
