The Secretary of State for Transport, in exercise of the powers conferred by section 65 of the Road Traffic Regulation Act 1984(1) and of all other powers enabling him in that behalf, hereby gives the following Directions:
1. These Directions may be cited as the Traffic Signs (Amendment) General Directions 2003 and shall come into force on 1st March 2003.
2. The Traffic Signs General Directions 2002(2) shall be amended as follows.
3.—(1) Direction 58 shall be amended as follows.
(2) After paragraph (4) there shall be inserted the following paragraphs—
“(5) A stud which—
(a)is of a type which was approved by the Secretary of State under direction 50 of the Traffic Signs General Directions 1994(3); and
(b)is placed temporarily on a road in connection with road works,
shall be treated as having been approved under paragraph (1), even though it was not approved for the purpose mentioned in paragraph (2), and paragraphs (3) and (4) shall apply to it accordingly.
(6) Paragraph (5) shall cease to have effect on 31st January 2005.”

These Directions amend direction 58 of the Traffic Signs General Directions 2002 (type approval of road studs) until 31st January 2005. Approvals given under direction 50 of the revoked Traffic Signs General Directions 1994 (which direction 58 of the 2002 Directions re-enacts with modifications) are to be treated as given under direction 58(1) even though they could not actually be so given, because they were not given for testing purposes as required by direction 58(2). The amendment ceases to have effect on 31st January 2005.

Section 65 was amended by the Roads (Scotland) Act 1984 (c. 54), Schedule 9, paragraph 93, the Local Government and Housing Act 1989 (c. 42), section 153, the New Roads and Street Works Act 1991, Schedule 8, paragraph 48 and the Road Traffic Act 1991 (c. 40), Schedule 4, paragraph 29. Amendments were made relating to the exercise of powers under section 65 by S.I. 1999/672 and 1750. By virtue of S.I. 1999/3143 the functions under section 65 which were exercisable by “the Ministers acting jointly” were transferred to the Secretary of State.
